Daniela Kinkeldey

Daniela is a German and European patent attorney and advises and represents clients in the field of intellectual property law, in particular in the life sciences field. She is a member of the Intellectual Property Group of Bird & Bird in Munich.
She has gained a broad experience in European and German patent law in representing clients in legal proceedings relating to patents, in particular for obtaining patents and in defending and opposing patents in opposition procedures before the German and European Patent Office and in nullity suits before the German Federal Patent Court. In addition, she has vast experience in advising clients and opinion work in the field of patent infringement in the life sciences field and in advising clients on questions of German employee inventor’s law.
Her technical focus is mainly in the field of organic and pharmaceutical chemistry, but she has also represented clients in various other chemical fields such as the fibre industry and inorganic chemistry.
Daniela was admitted as a German Patent Attorney and European Trademark Attorney in 1998 and as a European Patent Attorney in 1999. She studied chemistry at the University of Munich, obtained her Diploma in Chemistry in 1991 and her Doctorate in Organic Preparative Chemistry in 1995.
Daniela is a member of FICPI, LES, GDCh (Society of German Chemists) and VPP (Association of Intellectual Property Experts). She speaks German, English and Italian.
Patent Attorney - Balancing act between Science and Law
Being a Patent Attorney may be considered as a balancing act between law and science. For me this profession, however, always constituted a welcome combination of the best of both worlds. After having completed my PhD studies in organic chemistry at the University of Munich, I passed the German and European Patent Attorneys' exams within the following years. I started out in a small boutique patent attorneys' law firm, moved to larger sized patent attorneys' firms and am now a partner in a large international law firm.
Patent Attorneys help their clients in obtaining intellectual property rights in all sectors and eventually enforcing and defending them against their competitors. Therefore, it is important to know the technological fields of your clients - hence the technical or scientific degree of patent attorneys. It is a pleasure in this profession to be able to deal with scientists doing the research for our clients and therewith keeping in touch with the latest developments, and combining this with working on the legal side in developing legal strategies for protecting our clients’ interests. Last not least patent attorneys represent before a number of courts in litigious proceedings and the entire profession is very internationally orientated as intellectual property is rarely limited to one country but usually expands around the world.
